Terms of Service
Last updated: 29 September 2026
Welcome to Rememberd.
These Terms of Service ("Terms") govern your use of the Rememberd. website and your purchase of products and services from us.
By accessing our website, creating an account, placing an order or purchasing a product from Rememberd., you agree to these Terms.
Please read them carefully before placing an order.
1. About Rememberd.

Throughout these Terms, "Rememberd.", "we", "us" and "our" refer to the business operating the Rememberd. store.
"Customer", "you" and "your" refer to any person accessing our website or purchasing from us.
2. Our Products
Rememberd. sells both personalised and, where offered, non-personalised products.
Personalised products may include custom embroidery, printed apparel, line-art designs, photographs, names, dates, coordinates, messages, illustrations and other customer-selected personalisation.
Because personalised products are individually created for a specific customer, they cannot ordinarily be resold.
Product photographs and digital mock-ups are intended to provide a reasonable representation of the final product. Slight variations may occur due to fabric texture, embroidery, printing processes, thread, lighting, screen settings and the handmade or personalised nature of production.
3. Placing an Order
When placing an order, you are responsible for ensuring that all information submitted is accurate.
This includes:
-
Your name and contact information;
-
Delivery address;
-
Product selection;
-
Size and colour;
-
Uploaded photographs;
-
Names, dates, coordinates and messages;
-
Embroidery or print instructions; and
-
Any other personalisation instructions.
You will have an opportunity to review your order before submitting it.
An order is subject to acceptance by Rememberd.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, an obvious pricing error has occurred, payment cannot be verified, the requested customisation cannot reasonably be produced, or the requested content infringes applicable law or third-party rights.
If we cancel a paid order before production for reasons attributable to Rememberd., any amount due to you will be refunded.
4. Custom Artwork
Where your order requires custom artwork, Rememberd. may transform your submitted photograph, image or instructions into artwork suitable for embroidery, printing or another production method.
Creating line art or other artwork from a photograph involves a degree of artistic interpretation.
The finished artwork may therefore not reproduce every feature contained in the original photograph.
Where artwork approval is provided to you, it is your responsibility to review the artwork carefully.
You must check, where applicable:
Names;
Spelling;
Dates;
Colours;
People or pets depicted;
Positioning;
Messages;
Coordinates; and
Other requested details.
Once you approve the artwork, Rememberd. may begin production.
5. Cancellations of Personalised Orders
You may request cancellation of a personalised order before Rememberd. begins creating the custom artwork.
Please contact us immediately at joy@rememberd.co.za if you wish to cancel.
Once custom artwork has been created or production has begun, the order is considered personalised and we generally cannot accept a cancellation or change-of-mind refund.
This does not limit any statutory rights you may have where goods are defective, unsafe, damaged, incorrectly supplied or otherwise subject to a remedy under applicable South African law.
Please see our separate Refund & Returns Policy for further information.
6. Artwork Approval
Where Rememberd. requests approval of artwork, production will generally only begin once the customer has approved the design.
Once artwork has been approved, changes may not be possible.
If a change can still be accommodated, additional design or production charges may apply. We will inform you of any additional charge before proceeding.
Rememberd. is not responsible for errors contained in information or artwork that the customer supplied and expressly approved, except to the extent that applicable law provides otherwise.
7. Customer-Supplied Photographs and Content
By uploading a photograph, image, message, illustration, name, logo or other content to Rememberd., you confirm that:
-
You have the right or appropriate permission to provide and use the content for the requested product;
-
Our use of the content for fulfilling your order will not knowingly infringe another person's intellectual property or other legal rights; and
-
The information you provide is accurate to the best of your knowledge.
You retain ownership of content that belongs to you.
You grant Rememberd. a limited licence to use, reproduce, adapt and process the submitted content only to the extent reasonably necessary to create, manufacture, administer and fulfil your order, subject to our Privacy Policy.
Uploading a photograph for personalisation does not automatically grant Rememberd. permission to use that photograph or your personalised product for advertising, social media or promotional purposes.
Where we wish to use identifiable customer content for marketing, we may request separate permission.
8. Prohibited Content
We reserve the right to decline personalisation requests containing content that is unlawful, infringes intellectual property rights, promotes unlawful discrimination or hatred, constitutes unlawful harassment, or otherwise cannot legally or reasonably be produced.
Where appropriate, we may contact you and allow you to submit an alternative design.
9. Intellectual Property
The Rememberd. name, branding, website design, original graphics, product presentation, copy and other original materials created by Rememberd. are owned by or licensed to Rememberd., unless otherwise stated.
They may not be copied, reproduced, distributed or commercially exploited without our permission, except as permitted by law.
Customer-supplied photographs and other customer-owned content remain the property of their respective owners.
10. Prices
Unless otherwise stated, prices displayed on our South African store are expressed in South African Rand (ZAR).
The total amount payable will be displayed during checkout, including applicable delivery charges and other charges where relevant.
Where VAT applies, pricing will be handled in accordance with applicable South African tax requirements.
We may change our prices from time to time. A price change will not ordinarily affect an order already accepted and paid for.
If an obvious pricing or technical error occurs, we may contact you before fulfilling the order and provide the option to proceed at the correct price or cancel the affected order for a refund.
11. Promotions and Discount Codes
From time to time, Rememberd. may offer:
Discount codes;
Launch offers;
Free delivery;
Promotional pricing;
Competitions; or
Other incentives.
Promotional offers may be subject to additional terms, including expiry dates, minimum order values and product exclusions.
Unless expressly stated otherwise, promotions cannot be combined.
We reserve the right to refuse fraudulent or unauthorised use of promotional codes.
12. Payment
Orders must be paid using one of the payment methods made available during checkout.
Payments may be processed by independent third-party payment providers.
Rememberd. does not intentionally store complete payment-card details where payments are processed securely by third-party payment providers.
An order will generally not enter production until the required payment has been successfully received or authorised.
13. Delivery
Rememberd. delivers using third-party courier or delivery providers.
Estimated production and delivery times may be displayed on our website or communicated when your order is processed.
Because personalised products must first be designed and manufactured, production time is separate from courier delivery time.
Delivery estimates are estimates rather than guarantees unless expressly agreed otherwise.
We will take reasonable steps to fulfil orders within the agreed or represented period and will deal with material delays in accordance with applicable law.
Customers are responsible for providing an accurate and complete delivery address.
Additional delivery charges may apply where an order must be resent because the customer supplied an incorrect or incomplete address, except where the problem was caused by Rememberd. or its service provider.
14. Risk and Delivery
Responsibility for delivery will be dealt with in accordance with applicable South African consumer law.
If your package arrives visibly damaged, please photograph the packaging and product and contact us promptly at joy@rememberd.co.za.
15. Returns, Defects and Refunds
Our Refund & Returns Policy forms part of these Terms.
Because personalised products are made specifically for an individual customer, change-of-mind returns and cancellations may be restricted once custom artwork has been created or production has begun.
However, nothing in these Terms removes rights or remedies that a consumer is entitled to under applicable South African law.
If a product is defective, damaged, unsafe, incorrectly supplied or materially different from what was agreed, please contact us at:
or
084 746 1814
Please provide your order number and photographs where appropriate so that we can investigate the issue.
16. Product Sizing
Customers are responsible for reviewing the applicable size guide before purchasing clothing.
Because personalised garments cannot ordinarily be resold, we generally cannot exchange a correctly supplied personalised garment solely because the customer selected an incorrect size.
If Rememberd. supplies a size different from the size stated in your confirmed order, please contact us.
17. Website Accounts
Where our website allows customer accounts, you are responsible for maintaining the confidentiality of your login credentials.
You are responsible for activity conducted through your account to the extent permitted by law.
Please notify us promptly if you believe your account has been accessed without permission.
18. Website Availability
We aim to keep our website available and functioning correctly, but uninterrupted availability cannot be guaranteed.
We may temporarily suspend or restrict access for maintenance, security, technical or operational reasons.
We are not responsible for circumstances outside our reasonable control, subject always to rights and remedies that cannot lawfully be excluded.
19. Third-Party Services
Our website may use or link to third-party services, including:
Payment processors;
Courier companies;
Shopify applications;
Social media platforms; and
Other technology providers.
Third-party services may be subject to their own terms and privacy policies.
Rememberd. remains responsible for its own obligations to customers as required by applicable law.
20. Personal Information and Privacy
Rememberd. processes personal information in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).
Personal information may be processed where reasonably necessary to:
Process orders;
Create personalised artwork;
Communicate with customers;
Process payments;
Arrange delivery;
Provide customer service;
Prevent fraud;
Maintain required business records; and
Carry out marketing where lawfully permitted.
Further information should be provided in our Privacy Policy.
21. Marketing Communications
Where you have consented or where otherwise permitted by applicable law, we may send you promotional communications.
Where required, marketing communications will provide an appropriate method to unsubscribe or opt out.
Transactional communications relating to an order, payment, artwork approval or delivery are not necessarily marketing communications.
22. Reviews and User Content
If you voluntarily submit a product review, testimonial or other content for publication, you grant Rememberd. permission to display that content in connection with our business, subject to applicable law.
We will not knowingly alter a customer review in a way that materially misrepresents the customer's opinion.
Use of identifiable customer photographs for promotional purposes may be subject to separate consent where appropriate.
23. Limitation of Liability
Nothing in these Terms is intended to exclude or limit liability where doing so would be unlawful, or to exclude any consumer right that cannot lawfully be waived.
To the extent permitted by applicable law, Rememberd. will not be responsible for indirect or consequential losses that were not reasonably foreseeable and that do not arise from a breach of a mandatory legal obligation owed by Rememberd.
Nothing in these Terms excludes liability for gross negligence or any other liability that cannot lawfully be excluded.
24. Consumer Protection
These Terms are intended to operate consistently with applicable South African law, including, where applicable:
-
The Consumer Protection Act 68 of 2008;
-
The Electronic Communications and Transactions Act 25 of 2002; and
-
The Protection of Personal Information Act 4 of 2013.
Nothing contained in these Terms is intended to waive, restrict or remove a consumer right where such right cannot lawfully be waived or restricted.
If any provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail.
25. Complaints and Disputes
We encourage customers to contact Rememberd. first so that we have an opportunity to resolve a complaint.
Contact:
Email: joy@rememberd.co.za
Telephone: 084 746 1814
Where a dispute cannot be resolved directly, consumers may have the right to refer an eligible complaint to an applicable consumer protection body or alternative dispute-resolution scheme, including the Consumer Goods and Services Ombud where applicable.
Nothing in this clause prevents either party from exercising rights available under South African law.
26. Governing Law
These Terms and transactions concluded through the Rememberd. website are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and the jurisdictional rights available to consumers.
27. Changes to These Terms
We may update these Terms periodically to reflect changes to our products, website, business practices or applicable law.
The current version and effective date will be published on our website.
Changes will not retrospectively remove rights that have already accrued to a customer under an existing transaction or applicable law.
28. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.
The remaining provisions will continue to apply.
29. Entire Agreement
These Terms, together with the policies referenced in them and the specific details of your order, constitute the terms governing your purchase from Rememberd., subject to any rights arising under applicable law.
